North Carolina Deck Collapses and Vacation Rental Act (Vra) in 1999

One troubling trend that has developed in recent years involves deck collapses at vacation rental properties. In 1999, the North Carolina legislature decided to add provisions that pertain to the state’s robust vacation industry. Though the Vacation Rental Act (VRA) requires landlords to keep properties in a fit and habitable condition, thousands of vacation rental properties are owned by individuals that never visit the properties in person. They may be managed by brokers or property management organizations that may or may not be diligent regarding notifying landlords about needed inspections and maintenance.

Some of the key provisions of the VRA include:

  • Compliance with building and housing codes
  • A requirement that the landlord make all repairs and do what is reasonably necessary to put and keep the property in fit and habitable condition
  • Guidelines that encompass plumbing, electricity, heating, appliances, and more
  • That smoke detectors and a carbon monoxide detectors are present and functional
  • The responsibilities that apply to tenants include maintaining sanitary conditions, trash removal, and accountability for any damages that extend beyond normal “wear and tear”

Common Types of Deck and Rail Collapse Injuries

  • Head injuries: These may range from mild concussions to severe traumatic brain injuries
  • Back and neck injuries: May include bruises, whiplash, or spinal cord injuries
  • Broken bones: Fractures are possible throughout the body
  • Internal organ injuries: Including damage to the spleen and kidneys
